These Terms of Service govern your use of this website and any roadside services requested from Jagger Auto Inc., doing business as All Out Roadside Assistance (“All Out Roadside Assistance,” “we,” “us,” or “our”).
By using this website, submitting a request, calling dispatch, authorizing work, or accepting roadside assistance, you agree to these Terms of Service.
1. Roadside Services
All Out Roadside Assistance may provide services including:
- Vehicle lockout assistance
- Battery jump-starts
- Flat tire changes
- Emergency fuel delivery
- Battery delivery and installation
- Select mobile mechanic and diagnostic services
- Other roadside services specifically confirmed by dispatch
Service availability depends on your location, vehicle type, weather, traffic, road conditions, technician availability, required equipment, and the nature of the problem.
Unless specifically confirmed by dispatch, submitting a request does not include towing, vehicle recovery, storage, transportation, or extensive mechanical repairs.
2. Emergency and Roadside Safety
All Out Roadside Assistance is not an emergency response agency.
Call 911 immediately when someone is injured, a vehicle is creating an immediate traffic hazard, there is a fire or fuel leak, or you otherwise believe there is an immediate danger.
Call 911 when:
- Someone is injured or may require medical attention
- A vehicle is involved in an active accident
- There is a fire, fuel leak, or hazardous material
- A vehicle is blocking active traffic
- You are stopped in an unsafe roadway location
- You feel threatened or are otherwise in immediate danger
Remain in a safe location whenever possible and follow the instructions of law enforcement, firefighters, highway personnel, or other emergency responders.
3. Service Requests and Dispatch
Calling, texting, or submitting a website form does not by itself guarantee that a technician has been dispatched.
A service request is accepted only after our dispatch team confirms service availability. We may decline, postpone, or cancel a request when:
- The location or working conditions are unsafe
- The requested work is outside our capabilities
- The vehicle requires equipment that is not available
- The customer provides incomplete or inaccurate information
- The customer cannot demonstrate authorization to access the vehicle
- A technician cannot safely or legally complete the service
- Circumstances outside our reasonable control prevent service
Website forms should not be used as the sole method of requesting immediate roadside help. Calling 970-412-6926 is the fastest way to confirm availability.
4. Arrival Times
Any arrival time provided by dispatch or a technician is an estimate only and is not guaranteed.
Arrival times may be affected by:
- Traffic congestion
- Road closures
- Weather and road conditions
- Distance from the available technician
- Current service volume
- Incorrect or incomplete location information
- Vehicle access restrictions
- Emergency conditions or events outside our reasonable control
We are not responsible for losses caused solely by a change in an estimated arrival time.
5. Customer Information
You agree to provide complete and accurate information about:
- Your location
- The vehicle
- The requested service
- The condition of the vehicle
- Known damage or mechanical problems
- Road, parking, clearance, and access conditions
- Any condition that could create a safety risk
Inaccurate or incomplete information may result in delays, an inability to complete the service, or additional charges.
6. Authority to Request Service
You represent that you are the vehicle owner, lawful operator, or a person authorized by the owner or operator to request service.
We may request identification, vehicle registration, rental documentation, proof of ownership, or other evidence of authorization before performing a lockout or another service.
We may refuse service when ownership, lawful possession, or authorization cannot be reasonably verified.
7. Pricing
Basic daytime roadside services may be advertised as starting at $65. This is a starting price and is not a guaranteed total for every service request.
Additional charges may apply for:
- Mileage or extended travel
- Fuel
- Replacement batteries or other parts
- Processing fees
- After-hours service
- Multiple requested services
- Special tools or equipment
- Extended labor or diagnostic time
- Difficult, unusual, or unsafe service conditions
We will attempt to explain expected charges before work begins. Conditions discovered after arrival may change the estimated or quoted price.
You agree to pay all authorized charges when service is completed unless another arrangement has been approved in writing.
8. Estimates and Quotes
Pricing provided by telephone, text message, website, or other remote communication is based on the information available before the technician inspects the vehicle and location.
An estimate may change when the vehicle, location, requested service, required equipment, or actual condition differs from the original description.
We will request authorization before performing materially different work whenever reasonably possible.
9. Payment
Payment is due when the authorized service is completed unless another payment arrangement has been approved.
Available payment methods may include cash, major payment cards, or approved electronic payment services. Available payment options may vary and should be confirmed with dispatch.
You are responsible for any chargeback, returned payment, collection, or processing costs resulting from an invalid or improperly disputed payment, to the extent permitted by law.
10. Cancellations and No-Show Charges
Contact dispatch immediately when service is no longer needed.
A dispatch, cancellation, mileage, or no-show charge may apply when it was disclosed before dispatch or otherwise agreed, including when:
- A technician has already been dispatched
- A technician has traveled toward or arrived at the location
- The customer cannot be reached
- The vehicle is not present at the provided location
- The location information is materially inaccurate
- The customer receives help from another provider without notifying us
- The customer is unable to demonstrate authorization to access the vehicle
11. Vehicle Lockout Services
Lockout assistance will be performed only when the customer demonstrates lawful authority to access the vehicle.
Some vehicles cannot be safely unlocked with standard roadside tools. We may decline service or recommend a locksmith, dealership, or other specialist.
Preexisting damage, worn weatherstripping, modified locks, damaged windows, electronic security systems, and previous entry attempts may increase the risk of damage or prevent successful entry.
You must disclose any known damage or prior attempts to enter the vehicle before work begins.
12. Flat Tire Services
A standard roadside tire change generally requires:
- A safe and accessible vehicle location
- A safe and usable spare tire
- A compatible wheel and tire
- Accessible lug nuts and any required wheel-lock key
- Suitable lifting points
- Stable ground on which the vehicle can be lifted
We may decline to lift a vehicle when the ground is unstable, the vehicle is too close to traffic, the lifting points are damaged, the spare tire is unsafe, the lug nuts cannot be safely removed, or the work cannot be completed safely.
Temporary spare tires may have speed, mileage, load, and handling limitations. Follow the vehicle manufacturer’s instructions and arrange for permanent tire repair or replacement as soon as possible.
13. Jump-Starts
A jump-start does not guarantee that the vehicle will start, continue running, or restart after being turned off.
Starting problems may be caused by the battery, alternator, starter, wiring, ignition system, fuel system, security system, or another mechanical or electrical condition.
We may decline a jump-start when the battery is damaged, leaking, frozen, improperly installed, inaccessible, or presents another safety concern.
14. Battery Delivery and Installation
Battery availability and compatibility depend on the vehicle’s year, make, model, engine, equipment, and battery requirements.
Battery delivery and installation charges are separate from the purchase price of the battery unless expressly included in the quoted amount.
A replacement battery does not guarantee that the vehicle has no other charging, starting, electrical, or mechanical problems.
Manufacturer warranties, when available, are subject to the battery manufacturer’s separate terms and requirements.
15. Emergency Fuel Delivery
You are responsible for accurately identifying the vehicle’s required fuel type.
We are not responsible for damage caused by incorrect fuel information provided by the customer.
Emergency fuel delivery is generally intended to provide enough fuel to reach a nearby service station. It is not a full-tank delivery service unless specifically agreed.
The cost of fuel is separate from the roadside service charge unless expressly stated otherwise.
16. Mobile Mechanic and Diagnostic Services
Roadside diagnostics and repairs are limited by the location, weather, lighting, available tools, vehicle condition, and ability to inspect the vehicle safely.
A roadside diagnosis is a professional assessment based on the information and conditions available at that time. It is not a guarantee that every mechanical or electrical problem will be identified.
Some vehicles require shop equipment, vehicle lifts, specialized diagnostic tools, manufacturer programming, or further testing. We may recommend additional diagnosis or repair by an appropriately equipped repair facility.
17. Customer Responsibilities
You agree to:
- Follow reasonable safety instructions
- Remain in a safe location whenever possible
- Keep children, passengers, and animals away from the work area
- Disclose hazardous or unsafe conditions
- Provide reasonable access to the vehicle
- Provide any required keys, wheel-lock keys, or vehicle information
- Obtain permission from a property owner or parking facility when required
- Secure or remove valuable personal property when appropriate
- Avoid interfering with the technician’s work
18. Preexisting Conditions
You must disclose known vehicle damage, missing parts, aftermarket modifications, damaged locks, damaged wheels, corroded components, mechanical defects, or other conditions that could affect the requested service.
All Out Roadside Assistance is not responsible for preexisting damage, ordinary wear, corrosion, defective parts, hidden defects, manufacturer defects, prior improper repairs, or damage resulting from a condition not caused by our negligence.
19. Service Results
We do not guarantee that roadside service will restore a vehicle to operating condition or eliminate the need for towing, shop diagnosis, or additional repairs.
Payment remains due for authorized travel, inspection, diagnostic work, labor, fuel, parts, or attempted service even when the vehicle cannot be started, unlocked, repaired, or returned to service, unless otherwise required by law or agreed in writing.
20. Third-Party Roadside Programs
We may receive service requests from insurers, roadside networks, dispatch platforms, dealerships, repair facilities, membership programs, or other third parties.
Coverage limits, reimbursements, membership benefits, deductibles, and contractual obligations between you and a third party are controlled by your agreement with that third party.
We are not responsible for a third party’s denial of coverage, reimbursement, or benefits.
21. Website Use
You may not use this website to:
- Submit false, misleading, or fraudulent service requests
- Impersonate another person
- Attempt to access a vehicle without authorization
- Interfere with website operation or security
- Introduce malware, malicious code, or automated attacks
- Collect information about other users without authorization
- Use the website for an unlawful purpose
22. Website Information
We attempt to keep website content accurate and current. However, service areas, prices, availability, promotions, telephone numbers, business hours, and service descriptions may change.
Website content is provided for general information and does not replace a confirmed quote, dispatch confirmation, or service authorization.
23. Third-Party Links
This website may contain links to maps, payment providers, social media platforms, roadside networks, or other third-party websites and services.
We do not control and are not responsible for third-party content, availability, security, pricing, terms, or privacy practices.
24. Intellectual Property
Website text, branding, photographs, logos, graphics, designs, and other content owned by Jagger Auto Inc. or All Out Roadside Assistance may not be copied, republished, distributed, modified, or commercially used without prior written permission.
25. Disclaimer of Warranties
To the fullest extent permitted by law, this website is provided on an “as available” basis. We do not guarantee uninterrupted access, error-free operation, or that all website information will remain current at all times.
Roadside services are subject to the vehicle’s condition, available equipment, environmental conditions, technician safety, and other practical limitations.
Nothing in these Terms excludes warranties or protections that cannot legally be excluded.
26. Limitation of Liability
To the fullest extent permitted by law, Jagger Auto Inc. and All Out Roadside Assistance will not be liable for indirect, incidental, special, punitive, or consequential damages arising from website use, delayed arrival, unsuccessful service, or the condition of the vehicle.
These damages may include lost income, missed appointments, travel delays, loss of use, loss of business, or additional transportation expenses.
This limitation does not apply to gross negligence, willful misconduct, or liability that cannot be limited under applicable law.
27. Indemnification
To the extent permitted by law, you agree to be responsible for claims, damages, costs, or expenses resulting from:
- False or materially inaccurate information you provide
- An unauthorized service request
- Your unlawful conduct
- Your material violation of these Terms
- Your failure to disclose a known hazardous condition
28. Privacy
Information submitted through the website or during a service request is handled as described in our Privacy Policy.
29. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.
Subject to applicable law, disputes relating to these Terms or our services will be brought in an appropriate state court located in Larimer County, Colorado, or an appropriate federal court in the District of Colorado.
30. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
31. No Waiver
A failure to enforce any provision of these Terms does not waive the right to enforce that provision later.
32. Changes to These Terms
We may update these Terms periodically to reflect changes in our services, website, business practices, or legal obligations.
